Who can Act as PC for Subdivision Works?

Unlike “Building Works”, there are limited circumstances in which a subdivision certifier can act in the role of PC for “Subdivision Works”.

The Principal Certifier (PC) for Subdivision Works is ultimately required to issue the Subdivision Certificate (SC).

Division 6.2, Section 6.5 of the NSW EP&A Act only allows a subdivision certifier to issue a Subdivision Certificate, where a relevant Environmental Planning Instrument (EPI) permits it.

For Local Government Approvals (i.e. via Councils) the EPI is typically a Council LEP.  Unfortunately, the majority of NSW Council LEPs do not provide the required permission.

However, for State Government Major Project approvals such as SSDs or SSIs that involve the process of subdivision, a subdivision certifier such as Civil Certification is permitted to act as PC.
