Subdivision Work Vs Building Work

The NSW EP&A Act recognizes only two types of work:- “Building Work” and “Subdivision Work”.  S6.1 of the Act defines these as follows:

Building Work – means any physical activity involved in the erection of a building”.

Subdivision Work – means any physical activity authorised to be carried out in connection with a subdivision under the conditions of a development consent for the subdivision of land.”. Simply speaking, this means any consent with the word “Subdivision” included in the description.

A problem with the above definitions is that there are numerous examples where approved works have nothing to do with erection of building but incorporate significant civil or structural works without the process of subdivision.

In these circumstances we find that a building certifier is uncomfortable in issuing a CC as the type of work is unfamiliar.

The work around is for an experienced civil engineer/subdivision certifier to assist the building certifier

Civil Certification has developed relationships with several experienced building certifiers for this type of scenario.  We provide expertise in civil engineering matters, review designs, supervise construction and then issue a EP&Act Part 6 compliance certificate that the building certifier can rely upon is issue of both CCs and OCs.
