The Subdivision Certification Process

In NSW the subdivision certification process can be summarized as follows:

  • Development Application (DA) / CDC: Obtain DA approval from council or a Complying Development Certificate (CDC) from an accredited certifier;
  • Subdivision Works Certificate (SWC): If physical works are required, a SWC must be obtained under Section 6.13 of the EP&A Act;
  • Compliance Certificates: Inspections to ensure works are completed to standard and conform to the DA conditions;
  • Final Subdivision Survey: A registered surveyor prepares the final survey and Deposited Plan (DP);
  • Subdivision Certificate Application: Apply via the NSW Planning Portal to the council or a private certifier to confirm all requirements are met; and
  • Registration with NSW LRS: Once the SC is issued, the final plans are registered with NSW Land Registry Services.

There are many types of subdivisions:

  • Torrens Title;
  • Strata Title; and
  • Community Title.
